20 Years For Boyfriend Who Caused Infant’s Fatal Injuries

(Boone County, Ind.) – A Walton man has been ordered to serve 20 years in prison for the fatal injuries he dealt to an infant.

Cody Jene Phelps, 25, was watching seven-week-old Aiden Wainscott, the son of his girlfriend, in 2015. That November, the baby was found unresponsive in his crib. Aiden was transported to St. Elizabeth’s Hospital where he was pronounced dead.

Investigators later learned that the child’s had suffered head trauma and broken bones. Phelps was charged and arrested.

Phelps pleaded guilty in September to charges including first-degree manslaughter, Class B felony, and two counts of first-degree criminal abuse, Class C felonies.

Kentucky Attorney General Andy Beshear announced Wednesday that Phelps has been formally sentenced to 10 years for the manslaughter charge and five years for each of the criminal abuse charges. The total sentence is 20 years, which had been recommended by prosecutor’s in the attorney general’s office.

Phelps will not be eligible for probation or shock probation, Beshear said.

The Boone County Sheriff’s Office investigated the case.
