(Dearborn County, Ind.) – State child pornography charges have been dismissed against an Aurora man, as federal authorities are taking over the case.

Wayne D. Brown, 47, was charged with Attempted Child Exploitation and Possession of Child Pornography in Dearborn County on March 30.

Brown had been released from prison for a 2008 child pornography conviction. Parole agents had made a surprise visit to Brown’s home in December. There they found a laptop actively downloading child pornography.

On Tuesday, Dearborn-Ohio County Prosecutor Lynn Deddens announced that the state charges against Brown have been dismissed. Upon further review of the case and Brown’s prior convictions, the U.S. Attorney’s Office for the Southern District of Indiana was contacted by Deddens.

“The U.S. Attorney’s Office has the ability to leverage additional penalties under federal law against Mr. Brown because of his prior convictions for Child Exploitation and Possession of Child Pornography. These additional penalties do not exist under our state criminal code,” said Deddens.

The case has been turned over to federal authorities. Brown now faces federal charges of Possession of Child Pornography with a Prior Conviction.

If convicted in federal court, Brown faces 10 to 20 years in prison, as well as lifetime supervised release.
