Rep. McMillin Amends Police Entry Bill

Rep. Jud McMillin

Press release from Rep. Jud McMillin

(Indianapolis, Ind.) - Rep. Jud McMillin (R-Brookville) is sponsoring Senate Bill 1, which works to restore the rights a homeowner has to defend their home against unlawful entry, while also adding additional safeguards to protect police.

The bill was heard on a second reading Tuesday evening where one amendment was adopted. The adopted amendment put forth by Rep. McMillin has the support of the majority of the House, along with prosecutors, public defenders, Chiefs of Police, the National Rifle Association, Sheriffs Association, and other various agencies.

“This amendment makes the bill significantly better than it was before. With the adoption of this amendment, we have been able to garner support for this bill by police and citizens alike,” said Rep. McMillin. “It simply spells out the rights that we have had for 236 years with additional protections for those that put their lives on the line for us every day.”

The amendment better defines and explains the law. It restores a property owner’s right to protect themselves against anyone who acts unlawfully as has always been defined by the law.

“This is a difficult and tough issue. Every case is unique,” said Rep. McMillin. “Everybody should have the opportunity to resist anything unlawful that is happening to them, but we will not provide criminals a safe haven to conduct illegal activities behind closed doors.”

Senate Bill 1 will now be heard on a third and final reading in the House by Thursday’s statutory deadline.
