How Will Lawrenceburg Council Primary Race Tie Be Broken?

It won't be a coin flip to decide the winner in a tie between the two candidates for the Democratic nomination in Lawrenceburg City Council District 3.

(Lawrenceburg, Ind.) - There was one race in Lawrenceburg which ended with a tie Tuesday.

The Democratic primary for Lawrenceburg’s District 3 City Council seat saw Allen "Mooch" Callaway and Norman "Dan" Rogers tie with 25 votes a piece.

Assuming a recount of 50 ballots would not break the tie, there is another step toward deciding the winner.

According to the Indiana Election Administrator Manual, Indiana law dictates that when there is a tie vote in a primary election, it creates a “candidate vacancy.”

“The resulting vacancy is filled through a caucus of eligible precinct committeemen, the party chairman (if the chairman has received authority from the county committee to fill candidate vacancies), or a caucus of party officers,” the handbook states.

If the tie had occurred in the November general election, it would have to be by the local fiscal body. In the case of a Lawrenceburg council race, the tie would have to be broken by city council.
