(Chicago, Ill.) - A lawsuit in Chicago accuses the marketer of a purportedly small batch whiskey of not truthfully labeling that the beverage is actually distilled at MGP Ingredients’ distillery in Lawrenceburg. Templeton Rye’s bottle label states that the whiskey is “Produced and bottled by: Templeton Rye Spirits, LLC., Templeton, Iowa”. In the prohibition age, gangster Al Capone was reported to make Templeton Rye his whiskey of choice. In the class action lawsuit filed August 29 in Cook County, Illinois circuit court, plaintiff Christopher McNair claims Templeton Rye Spirits has a practice of deceptively marketing its Templeton Rye whiskey. McNair claims the company has violated Iowa and Illinois consumer fraud statutes. “Defendant has marketed Templeton Rye as being ‘small batch’ and ‘made in Iowa.’ Consumers, seeking an alternative to mainstream, mass-produced alcohols beverages have purchased hundreds of thousands of bottles of Defendant’s Templeton Rye and have paid a premium price over other whiskeys to obtain those qualities,” the complaint read. The lawsuit follows reports – The Daily Beast published this online article in July – that Templeton Rye is not a small batch. Rather, it is among the many vodka, gins, bourbon, and whiskeys mass produced by MGP Ingredients of Indiana. The plaintiffs in the class action are seeking injunctive relief, damages, and restitution. MGP Ingredients of Indiana was not named as a defendant in the lawsuit.
